When can I cop force you to open your hood
Just wondering when a cop (mainly in California) can really MAKE you open your hood. I've been asked a few times after being stop for BS reasona and always fought it. I know how cops try and get you to agree to it if they don't have any real evidence like they say "so you wouldn't mind letting look under your hood then" or " go ahead and open the hood"
when are they stopping the games and do they have authority to actually MAKE me open it?

im not a cop...but i think you have to sisten to them cause they have the upper hand. i dont understand why some are the way they are. cops are just people like you and me.

well you don't always have to listen to cops
I'm not saying that you don't have to pull over but when a cop is at a traffic stop they are trainned to make you "give up" rights you have, if I cop comes to your car after he stops you and says
Officer: "you seem drunk might if I look in your car"
you don't HAVE to let them search your car you can say NO if you say yes you are giving up your right to search they actually do need some type of evidence.
but then they just say that they smelt pot and can search under prob. cause.
it's a little different for the hood becuase they can't just be like
"Yeah I think I heard JUNIII Cams, AEM CAI, and SMSP headers back there when you hit VTEC lets pop that hood"

its reasonable suspicion, or plain smell doctrine. You don't have to meet probable cause to search by smell. Kinda confusing sorry. As for the hood thing I have no idea what it is in Cali, kevin can help when he's on. Florida doesn't have any laws regarding tuning, so it all good.

no i can't say for engine checking in cal what the laws are. Stuff is pretty tight out there I know that. I'm guessing if there is illegal exhaust that with the emissions laws they can search the rest of your car. Remember that searching a vehicle (conveyance) is not the same as a structure, less freedom.

yeah we are pretty slack but its mainly because of geographics. we dont need emisions because all our polution goes out to sea and doesnt effect us so politicians dont care. California has valleys and all this crap so the air polution gets stuck and cant get out. Thats why they are forcing all these emision laws because they need them.

it doesn't have anything to do with the right to drive, its more about the right to personaly propetry. If anything is acceptable by a smog test  shouldn't it be legal for me to change my own personal property?
I really dont mind doing it since everything I have is legal or extremely well hidden that a cop will never be able to cite me for it unless they tuned cars, but I just hate when cops are on a power trip and are complete assholes

you can own a firearm, but certain things you can't do to them. Like rifles with less then 16in barrels or shotguns with under 18 in barrels.
No matter how hardly you feel against them, YOUR legislators have passed the laws. Now you have to follow them.

In Cali, they can pull you over then walk around your car and find something wrong. Had this happen to me once and have heard similar story from 4-5people I know. In any case, you have to have somethign illegal visible anyways. I had blue tints  but yea...in Cali almost every car has some BS going on that a cop can point out. Those coffee can exhausts are probably #1 reason for hoods getting popped.

From what I understand you don't have to do anything that will incriminate(sp?) yourself unless the officer has probable cause.
